Amazon Customer Service Emails on A-Z Guarantee

On 10/27/2021, I ordered an item on the Amazon.com website. The order number is 112-5574230-1195403. The seller lives in another country. A few weeks later, I got the order. However, the model number for the product does not match the model number I buy. It seems to be counterfeit. I requested a return. The return was approved by the seller. However, the return label was corrupted and the post office refused to ship the item.

I have repeatedly asked the seller and Amazon to give me the correct return label, but I did not receive one. On December 1, 2021, Amazon Customer Service submitted an A-Z Guarantee claim to help me recover the money. They indicated that the request would normally be processed within seven days. However, every 1 or 2 weeks I have called, they have not yet processed the claim and have to either escalate it or submit another one.

So far, Amazon has spent over 3 months on the complaint and is still not able to complete it. I phoned their customer service 20-25 times. It seems that nobody in their customer service can solve the problem, even the supervisors. The only they can do is to create a new claim or to escalate the existing claim. They are powerless. I think if I keep working with Amazon customer service, it's not going to get anywhere.

Their advertised A-Z Guarantee is misleading the consumers. Also, on 3/9/2022, one supervisor (her name is Charity) told me that some of the previous Amazon employees have lied to me when they said they created the claim, but they actually did not. I am not sure why their customer service department is so corrupted.

 You're getting close to the statute of limitations if you're truly in California. I have a reputation with Amazon, who now a days, takes care of issues like this, to avoid me in small claims. I don't know how much you spent, so this may or not be helpful to you. Firstly, in case you didn't know, here in California, Small claims doesn't allow plaintiff, or defendant to use an attorney. This is fantastic, because those large companies like Amazon, aren't able to use their retained attorneys. Puts you both on equal footing. Depending on what they owe you, decides the court costs. You may not even have to go through with a case. This is what I do. I log into my local court, via their website, or use turbocourt if the court lists it as an option. I fill out the forms, then at checkout, I don't pay the fee yet, I print a copy, then email [email protected] with a copy of the small claims subpoena and a message that says this needs to be rectified, as I am about to file this in small claims. Include evidence and contact info, but no banking or personal information and send it. Chances are you will get a fake bounce email that says you wrote a non writable address. It's not true, they got it. Log into AP and request a rep. When you get a list of options, type chat and send. A circle with headset appears for a few seconds. Select it fast, and an option to chat and call shows. Do chat, so you can screenshot everything. When rep connects, give them the sales order number, and tell them to check the [email protected] address for your email. They will look at it, and do one of two things. Either forward you to the right rep, or give you a message to wait 48 hours. Waiting 48 hours is their way of blowing you off. Most of the time, the rep they transfer you to, will fix the problem. Most likely, refund you an Amazon gift card and possibly a provisional credit due to the long time that's gone by. Screenshot everything. Even your emails. Amazon sends you webpage emails, which means they can change, delete their messages and claim they have no record. It's up to you to screenshot all corospondance. Any time you catch them changing records, this can be used as evidence, hence why chat is better. You can't use a phone call as evidence, even if the other party said it was ok to record call. Now, if this fails, you can go back and pay the fees and they will serve Amazon certified return receipt if you choose this option. Even though papers say not to include court fees in your judgement request, do so anyways. Many judges do make exceptions, on a case by case basis. Can't afford the small fees, you can go to your local court and request a fee waver form for low income. The above sounds like a lot, but it's quite simple. If you read my older posts, you can see I don't let any company walk on me, I give them a courtesy small claims subpoena, and let them know it's not yet filed, but about to be. Always put what you want, as a request. Never demand anything, like saying give me this or Im filing. That can get you in trouble. Let them know your doing this as a courtesy, and would like the full refund they promised. Saying your going to sue gets you laughed at, and ignored. They see an actual small claims subpoena already filled out where they can't use their attorneys, those they look at and don't ignore, most of the time. I'm not an attorney, but been taught by a few at a young age, and have used the above to win many of my cases. Out of 90+ small claims incidents, I only had to file 15 times. I only lost 2 cases, and that was only because I procrastinated so long, that I found out there was another party I should have sued, and the statute of limitations had long run out. Small claims in California is really good. Unlike civil, there can only be one continuation request, and most of the time, depending on county, a fee must be paid, so on a worst case scenario, if your case isn't heard first time around, it will be the second time. Civil, those can go on years, but small claims is mostly, a one shot deal. Make sure you have the item at hand that's a fake, to show the judge. Including the packaging, along with screenshots. Another big helper, look on RipoffReport for others who reported similar or same problems. The judge will use this as evidence as well. If you go empty handed, you risk having to wait for a judgement card in the mail, or worse, losing your case. Make sure to have everything together. Neatly, and easy to find. Good luck!!
