I noticed a item on UBID that looked like a good deal. Blair Womenswear Mixed Season Blair Women's Assorted Bottom's. The add showed various slacks, shirts and shorts casual and dress. The tag line was;

Winning Bids Receive:
The winning bidder will receive 75 pieces of assorted women's bottoms. Items in this auction will be a range of dress slacks, casual slacks, and skirts.

There was also a note that read;

Important Note
Due to enormous value, this auction lot is final sale and seller will not accept back any returns for any reason, other then warranting pieces count.

Here is the con. I received a box with 75 pcs. They were all pants made out of polyester, in bright blues, pinks and reds. All of the colors could be described as neon. There were no skirts or shorts. The slacks are so cheap its laughable, if I did not have 245.00 tied up in it. All slacks have elastic waistbands and all are polyester. Nothing like the picture they used to sell me this junk.

I have tried again and again to obtain a refund, I believe I am a victim of fraud. UBID will not address the fact that the cloths are junk or that I received no shorts or skirts in the shipment or that the picture they used to sell it is so miss-leading. They do however point out the fact that there will be no refund because of the "enormous value". The seller of the ITEM is UBID and they are not giving refunds.

Rebuttal:
I've researched the rules and regulations of UBID and I must admit they are not very customer oriented. They are more to protect UBID's behind from complaints like yours.

Here's what you can do to get your money back.

1. First, send a formal letter to UBID that outlines how the seller used deceptive practices to sell the items. The pictures and wording did not accurately describe the articles. Tell them you plan to take the seller to small claims. UBID should ban the seller.

(By the way, the nonsense wording "no refunds" will not protect the seller's butt from fraud)

2. Go to YOUR local courthouse and file in small claims. Your complaint will be "deceptive practices."

You will need to bring the following to the actual court proceeding: A copy of the auction, any e-mails between you and the seller, the box of clothing, a copy of your cancelled check or money order and bring a smile for the judge. Be professional in court, the law is on your side this time. Ask for your money back and court fees.


3. Warn everyone you know not to use UBID and go to online auctions like Amazon or Ebay.
