Ironically Staffing Choice, Inc. appears to be one of the largest operators of temporary staffing services in the state of Indiana with offices throughout the state and at two offices in Ohio. Staffing Choice is a sub-contractor for Action-Link, a larger temporary staffing firm with offices in CA, OH and various other locations. These companies are hired by Circuit City, Costco, Sam's Club, Wal-Mart Stores, BJ's Wholesale Club and other big-box retailers to perform store resets, product demonstrations and merchandising operations.

Unfortunately, Staffing Choice doesn't pay! When contacted, this company ignores all e-mail correspondence, and never returns phone messages. (They simply don't care!) Further, there are reports of NSF checks issued out of Indianapolis. I worked for a Circuit City location in Delaware on their behalf in July, 2007 and was never compensated for work performed. Due to the fact this company never returns phone calls or acknowledges correspondence, I have taken the initiative to file this report to forewarn others considering employment assignments with either of these companies.

In all fairness to Staffing Choice, I would welcome a rebuttal from managers, Dana Arron and Thomas Spafford as well as past and present employees, etc. The IN Department of Labor, Wage & Hour division has been contacted to initiate an investigation into Staffing Choice. I will update this report if the company ever makes good on their obligation.

It's not surprising Staffing Choice lacks Workers Compensation coverage as reported by Salinas, CA attorney Clark Barber. Personally I was never compensated for services rendered on behalf of the Staffing Choice Muncie branch office July, 2007. Staffing Choice's Dana Aaron claims they were never paid under their contract with Action Link, a merchandising company based in OH. Action Link appears to be a reputable company which contracts with major retailers including Circuit City, BJ's Wholesale Club, Costco and Wal-Mart, Sam's Club, Inc.

Therefore, if they don't payroll obligations, it's not conceivable this employment agency would be complying with employment laws as well. In initially making application with Staffing Choice, there was no verification of identity process or request for W-2's, etc. This may be evidence Staffing Choice is hiring undocumented individuals as well and in the end not not meeting payroll obligations. There is something very sinister about this company as other individuals nationwide have reported similar issues and bounced checks, etc.

A manager at another location appeared to express some concern for a brief period of time, however efforts to resolve the matter waned. The bottom line is this firm's Muncie office (and possibly other locations) do not seem concerned about anything other than collecting money on contracts.

If you contract labor through this staffing agency you should be aware of potential liability on your behalf for the consequences of this firm's indifference to its employees and apparent non-compliance with labor laws!

Dana,

As pledged, I am writing to set the record straight. Unfortunately, web sites such as this one often do get results. To respond to your comments below, you are correct; I did not submit a time sheet because none was available on site, nor at any time did anyone from the company ask me to do so. (The hiring representative in Muncie should have been concerned about the issue when reported)

The last conversation from the company was your outbound call to me on August 28th pledging to investigate the matter. Neither you or anyone else from the company attempted contact in any form since that date or even prior to that date as I would have expected. You graciously provided your cell phone number, however attempts to reach you or anyone inside the company via phone or e mail were futile. Contact information is contained on the employment application and has been resent through the Staffing Choice web site to your attention. Where is the Muncie office in all of this? (Please request a resubmission if for some reason you did not/or do not receive it)

In regard to the third comment, no one else on the specified assignment was paid because they were no other contractors from Staffing Choice on that specific assignment.


I believe that I have posted here in good faith, and attest to the accuracy of the facts contained herein. Be aware that another poster on Craigslist claims to have been presented with an NSF check last month out of Indianapolis. Further, the poster cites a contract employee in FL with a similar issue as mine that you have or are currently assisting. (Identity information is available upon request) I will continue to update this report with the facts and nothing but the facts!

I appreciate that you welcome rebuttals. This is Dana, one of the managers that you mention in your report. I have spoke to you many times in regards to your pay from working at circuit city. As I have mentioned to you before, we need a time card in order to pay you. I have offered to send you a time card so that you can submit you hours and you refused to do so. I again offer to send you a time card so that you can properly submit your hours so that we can get you paid.

First and foremost all of these reports are false. I have done an investigation on the illeged accusations. What I found out was:

1. You never submitted a timesheet showing hours worked.

2. Tom and Dana (Staffing Choice) have advised you to submitt your hours so that you will be paid.

3. All other that worked for that specified assignment have been paid for the hours worked.

I would suggest rather than spending an exessive amount of time placing ads on websites listing how you aren't being paid, that you instead complete a timesheet, fax it in, and recieve a paycheck.

If you need a blank timesheet please contact Dana and she would be happy to email you the form. Fax the completed form in and we would be more than happy to pay you the amount due to you.
