Complaint Review: Scottsdale Police Officer J. Rusch VIOLATES OUR RIGHTS

My recent incident in Scottsdale was a traffic stop by one officer named J. RUSCH who was a motorcycle cop on the day he stopped me. He was sitting on chaparral between miller and Scottsdale road. He was sitting behind a retaining wall with his radar gun ON PRIVATE PROPERTY BECAUSE THAT IS ALL

THAT IS ON THAT SIDE OF THE ROAD.



 I made a right turn at the light on Chaparral and Scottsdale road and made it two blocks up the road when I heard this little horn. I looked into my mirror and here was this motorcycle with flashing lights.  I was shocked and really curious to see what he pulled me over for.  When he got to the window I asked him before hte could say a thing....I said what is the problem", his reply was "I will tell you just as soon as you give me your insurance, registration and driver license'. Unbuckled my belt and dug on my wallet, then dug into the console to get out the insurance card and registration. I said "What

registration are you talking about"? I am from Minnesota and we dont carry registration in our cars there?  He told me about it and I got to looking that is when it hit me. I just cleaned out this car of everything and put it into the exes new car and said I just got the car a couple days ago and thats where it is...He didnt buy it and started to lecture me about not having one in the car...I then said.."I just told you where it went, cut me break here pal, it would not be an act I would intentionally have done to evade the law and this is seriously low level crime to worry about. I then asked more about this stop, he said well, you went around a car and went over the speed limit on chaparral". I said the hell

I did, I went around a lady who was doing under 35, so I went around and got in the lane ahead of her.,.as it turns out, that woman was turning, so my move to the left and back into that lane was a good driving action. He said do you even know what the speed is on that road? I said I thought it was 45 but I have never gone that speed on this road because its such a short stretch and this is a busy street.  I didnt go over any speed limit and  now I  started to question him about it. I said, I want to see the radar gun, his reply was "he doesnt have to show it too me"!! I said The hell you dont, its a law and requirement of every officer the show a defendant this infraction against them if they ask to see

it, its in every state in this country. His reply was "and how did you come to know this," I said because they do it in Minnesota and i went to school to be a cop, its required or you can pull people over and do what you want.....he walked back to his bike and lifted up the radar gun and showed me an empty screen. I said "I dont see any numbers on the screen" He said "That is because I erased them" I said you cant do that, this another infraction against you pal, you just violated my rights"!! So he came back to the car and I was now standing up, on his way he said, I can get inside. I said I want my license before you lose it. I sat down and he then handed me his little ticket slip with three tickets on it. The first was the missing registration, the second was speeding and he gave me a ticket for not having a my seatbelt on. I was sitting down now and said youre a lying cop because I had it on and you know it because I had to take it off to get my wallet out....his reply was "Yeah but you put it on when I pulled you over"!! I said, youre a lying cop and I was warned about you officers and how you write out tickets for things that dont happen here. I said you cant see my seatbelt anyway because I sit so low in the seat and that the belts support right here is dropped to its lowest position. THE CAR IS A 92 BUICK

LESABRE AND THE SEATBELTS HAVE ADJUSTABLE RETRACTORS ON EACH SIDE FOR THE FRONT

SEATS. I have been stopped for this before years ago and the other officers didnt take their eyes off me as they walked to the car, then they realize the belt is buckled. This is when I said you pulled me over because of the appearance of my car in hopes you would find something juicy on me"!  His reply was "YOU'RE RIGHT I DID" I said, you cant do that then sit here and honestly write out three tickets.

He told me to sign the ticket and I told him I am not signing anything because I have no intention of admitting anything on paper. He said signing this means you will appear in court. I said, no it isnt, its a signature that specifies a person agrees with whats on the information card, I am no dummy.   He wrote down refusal to sign.



When i got home i went to the other car and got out the registration card out of the pile of papers that were there.



I WAS STEREO TYPED BY THIS OFFICER WHO STOPPED ME AND FABRICATED A LIST OF CHARGES FOR SPEEDING THAT HE COULD NOT SHOW ME ON HIS RADAR GUN.



What is even sicker is the Scottsdale Cops and Court get away with a widely known corrupt legal system.

I MADE IT TO THE FIRST COURT APPEARANCE AND SHOWED THE JUDGE MY PROOF OF REGISTRATION, THEN SHOWED HER MY NOTE ABOUT OFFICER RUSCHS PROCEDURE VIOLATION BUT SHE HANDED IT BACK AND TOLD ME TO KEEP IT UNTIL NEXT APPEARANCE.

I missed the second appearance because i marked the wrong date on the calender. When i appeared on the day i thought court was happening, my name wasnt on the board, so I asked to speak with a judge. I went before the judge and she told me because i missed the court date that the court automaticly finds the defendant in DEFAULT AND NOW YOU HAVE TO PAY THE FULL AMOUNT OF $691.00 FOR CORRUPTION.

THIS COURT DOES NOT ALLOW YOU YOUR RIGHTS IF YOU DONT HAVE A LAYWER TO REPRESENT YOU. THEY THROW OUT THE RULES AND TELL YOU WHAT THEY NEED TO TO GET YOU TO SUBMIT TO THEIR SUGGESTIONS.

I filed an appeal and just got the paper work but i cant afford a lawyer and I clearly dont trust the Scottsdale Court. Unless the media steps in right now. Im one week after the paper work for the appeal arrived. 03-30-1012

THIS COURT DOES NOT PROVIDE YOU ANY FAIR RIGHTS UNLESS YOU HIRE A PAID LAWYER. THEY WILL TACK ON THE HIGHEST FEES FOR EVERYTHING YOUR CHARGED FOR.



I sent certified letters to Maricopa Sheriff and the Chief of Police for Scottsdale. I suspect they will ignore me.

PEOPLE, this is my second case of court corruption, I caused the resignatiion of a corrupt publc defender after I blew the whistle in his corruption. This is a known fact all over that building as to why he quit. The Scottsdale Court has denied me the right to an appeal and the prosecutor is holding that  appeal in his office because they tampered with the court recordings in my case to make it look like I accepted this fabircation of justice against me. I have the proof to back my statement because they obtained fabricated evidence from the manager at the facility where my event happened and this man was terminated after I sent my statement to the insurance company and the owner of the local sports bar.

I have a witness who was present at every court appearance and she heard every lie the public defender told me about this case. HIS NAME IS EUGENE MARQUEZ OF TEMPE ARIZONA.

I want everyone to know that the SCOTTSDALE COURT IS SENDING OUT DUPLICATE CHARGES TO DEFENDANTS IN CASES WHERE THEY LOOK LIKE THEY ARE GOING TO BE A TOUCHY CASE. THIS IS DONE TO GET YOU TO ACCEPT THE VERBAL PLEA AGREEMENT. I did not sign the agreement and denied any acceptance to the fabricated restitution fees they placed on this case. I WAS DENIED MY RIGHT TO SPEAK BY JUDGE NANCY LEWIS AT A RULE 32 HEARING. THIS IS ON THE RECORDING. THIS IS A VOILATION OF OUR RIGHTS.
