IN MARCH OF 1999 WE BOUGHT A HOME IN THE SPRINGFIELD ADDITION. THE ADDITION WAS BUILD AND SOLD BY PULTE CORP. AFTER LIVING THERE APPROX 2 MO. I WAS TOLD BY MY NEIGHBOR THAT HE WAS A CLASS 2 SEX OFFENDER AND THAT THE ADDITION AND PULTE HAD BEEN NOTIFIEED ABOUT 10 MONTHS BEFOR I BOUGHT MY HOUSE THAT HE LIVED IN THE AREA. HE ALSO STATED THAT PULTE HAD OFFERED HIM 35000 ABOVE WHAT HE PAIDED FOR THE HOUSE TO MOVE, HE REFUSED. MY PROBLEM IS THAT WHEN I BOUGHT THE HOUSE I SHOULD HAVE BEEB TOLD OF THIS BY PULTE AND I SHOULD HAVE HAD THE RIGHT TO DECIDE IF I WANTED TO LIVE NEXT TO A CLASS 2 SEX OFFENDER. IF I WAS ALREADY LIVING THERE AND HE MOVED NEXT DOOR I WOULD HAVE NO CHOICE. I TALKED TO GENERAL SALES MANAGER AND GENERAL MANAGER AND THEY BASICILY SAID THEY COULD DO NOTHING. I TALKED TO BILL MALINOWSKI, HOA FACILITIES WHO DIDNT GET BACK WITH ME 602-802-7057. I WINT TO CORP. OFF. AND WAS TOLD I HAD TO DEAL WITH IT ON A LOCAL LEVEL OR GET AN A LAWYER. IF YOU CAN HELP IN ANYWAY I WOULD APPRECIATE IT. I JUST FEEL THAT I SHOULD HAVE HAD A CHOICE BEFORE BUYING. THIS MAN AFFECTS THE SAFETY OF MY GRANDKIDS AND ALSO LOWERS TH RESALE OF MY HOME IF I DESIRE TO SALE FRANKLIN W WINBORN

In the state of Arizona it is written into all Real Estate Contracts that the builder and or real estate agent cannot be held responsible for sex offenders in the area of your home. You as a consumer need to do this homework and not expect everyone else to do it for you. Look online, check things out, drive the area before you make sure a large investment. Try www.azsexoffender.org to find out if there is a sex offender in the area you are looking to purchase in. In today's real estate market there are many things LEGALLY that your agent may not disclose. Become informed and protect yourself.

Take your problem to the state's real estate division. They regulate those types of issues and require those types of disclosures.

You should have been told about your neighbor. Your sales agent or their broker should have errors and ommissions insurance and also the state should have some type of recovery fund.

That division of state government is designed to protect you from those types of problems. I would try that before hiring a lawyer.

They are there to dicipline those exact issues. The builder (or sales manager) isn't going to help you, that would be admitting guilt and they are probably expecting a lawsuit.
