I find myself stuck in a horrible situation with Oxmoor Toyota.

Prior to November 2nd, 2008, I had a 2002 Toyota Prius that I bought as a certified pre-owned car from Westbury Toyota in Long Island, NY in December 2006. On October 30th, I took the Prius in for her 5,000 mile checkup.

The following day, I received a message on my phone from Steffan Perich who works for Oxmoor Toyota saying that they would be interested in buying my Prius and putting me in a new car. I told him he wouldn't want my car as it was banged up and that I didn't have good enough credit for a new car.

He told me to come in anyway, so I did on November 2nd. That day, he asked me what car I would be interested in and I told him the Matrix or the Scion xD. He let me test drive a Scion xD and then told me a lease would be easier on me financially. I still wasn't sure it was the right thing as my payments for the Prius were $478.33 a month and the lease payments (I wouldn't even own the car) for the Scion would be $700, but he assured me that they would make it work. They gave me 30 days to come up with a $1,500 downpayment and I drove the Scion off the lot on November 2nd, excited because I thought my credit had been repaired enough and I was going to have a new car.

I received a message on my cell phone from Steffan on Friday, November 14th and called him back. At that time, he told me the bank would not okay the loan unless I put $6,000 down. I told Steffan I didn't have $6,000 to put down and that I would bring the Scion back and that I wanted my Prius back.

I went in on Saturday the 15th and handed over the keys to the Scion. At that time, he tried to get me to take a Camry which I didn't want. He then let me borrow a Corolla until they could see about financing for that. Everytime I mentioned getting the Prius back, he changed the subject.

My thinking is that they have already sold my car and I am completely screwed. Their paperwork that I signed pretty much covers their collective butts, but I think this is a deplorable way to do business. Now, it looks like I am going to be stuck in a car that I didn't want in the first place because they say I can't get financing for the car I really wanted (that they assured me I would get financing for.)

To me, this sounds like a first cousin to a bait and switch.

So, I need to complain about these business practices. In this economic climate, if they are going to be so hard up for business, then they need to make sure that they have all their ducks in a row, so to speak, before they go making promises they can't keep. They told me they would make this work and now they are putting all the pressure on me to come up with more money than they said I would need. This is wrong, plain and simple.

The original deal was to trade in the 2002 Prius on a 2009 Scion xD. Since they couldn't make that deal work, I want the Prius back. I do not want a new Corolla or a Camry.

This has been going on for two weeks now and I just want my car back so that I can put this fiasco behind me.

I wish I had known about this website before I got involved with these people as I would have known better than to get involved with them.

if one purchases a Scion , all finance approval MUST be completed before ANY Scion purchase is completed. If anyone doubts this (1) contact the regional Scion office, in this case 513-745-7500 and ask to speak with the Scion director.
no Scion should leave the lot until all finance is totally completed.
report any dealership that does not follow the rules.

What they did by letting you have the car when the financing was NOT SECURED is called "spot delivery."

They have you sign a purchase agreement, but even though there is NO FINANCING CONTRACT they let you take "your" new car.

IMO this practice should be OUTLAWED in every state. I suggest you write to your state lawmakers and URGE them to pass legislation making "spot delivery" illegal in your state.

If you do an internet search for "spot deliver" you will find some informative articles about this practice and learn to NEVER ACCEPT SPOT DELIVERY. A legitimate dealer will NOT RESORT to this tactic and I would recommend that in the future if a dealer attempts to let you drive away without a signed financing contract in place that you firmly state "NO DEAL" and then immediately leave-never to return.

AN IMMEDIATE DECISION regarding whether a customer qualifies for the purchase of a car based on their credit VIA computer, but TOYOTA DEALERSHIPS can't! Why is this?

ANSWER: TOYOTA DEALERSHIPS CAN get an immediate answer, but they KNOW what the answer is......so they allow the customer to take the car home, and they HOPE that the customer will come up with the additional money for a down payment, or get a co-signer.

To put it in plain words......TOYOTA DEALERSHIPS, most of them, WILL SCAM, LIE, CHEAT, DECEIVE, MANIPULATE, & try every tactic in the book, to make the sale!!!!

BOYCOTT TOYOTA, and their WAY OF DOING BUSINESS!

It is my understanding that the real reason for your current situation with Oxmoor Toyota was not the experience, but rather the horrendous credit situation that you are faced with. Oxmoor Toyota is not responsible for paying your bills on time. Nor were they responsible for your decision in paying too much for a used Prius.

I am led to believe that the employees at Oxmoor Toyota tried several different avenues to ensure your satisfaction with a Scion. When that goal was unattainable, they tried to meet your needs with a different vehicle. In all fairness they tried to earn your business. Most other dealerships would not have even given you the time of day.
The payments you were given was based upon your credit, (which is horrible) the negative equity of your vehicle, (which was tremendous) and the amount of the vehicle in question.

It is gravely unjust to slander an organization on the grounds of your inability to responsibly manage your own finances.

UPDATE: Situation Resolved

After filing this report yesterday (11/17/08), I received a call in the evening from Carolyn Gilbert, who is the manager of the Scion division at Oxmoor.

I called her back and she said she would like to meet with me as she had a proposal for me. She said if I didn't like the proposal, I could get my Prius back with no problem.

I met with her this evening (11/18/08) and she tried to sell me a 2009 Mitsubishi with 100K mile bumper to bumper warranty. She also held out a very enticing carrot of a $2000 Christmas cash check that I would receive.

The Mitsubishi was nice, but I wasn't interested in getting a Mitsubishi and told her the only car that I was interested in was the Scion xD which I can't get. So, I requested my Prius back. I received my Prius, my title and my postdated check for the downpayment on the Scion and walked out of there very, very relieved!

Now, I just have to make things right with Toyota for the car payment that was due while I was in the midst of this whole fiasco.

Nonetheless, the main problem is fixed and the rest can be worked out with Toyota, I'm sure. Well, I'm hoping anyway!

Thanks for allowing me to voice my displeasure with this whole episode. I have to think that by posting what I did that I was able to get the result that I needed to get.

If they can't get you financed due to your credit rating, and your income, etc., they MIGHT try something like this-

They could ALTER your Credit Application and RAISE your 'Monthly Income' on the Credit Application and TRICK the Bank into believing you make more money than you actually do! They could also increase the number of years on the credit application where it wants your EMPLOYMENT info! WHY? To get the loan approved!

They could also ALTER your 'Pay-Stubs' so the Bank believes you make MORE money than you actually do!!! WHY? To get the loan approved!!!!!!!!!!!!!!!!!!!!!!

They could also submit ENTIRELY NEW LEGAL DOCUMENTS to the Bank, with FORGED SIGNATURES, and trick the Bank into believing that it's your real information!!!!! WHY? To get the loan approved!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

They could do ALL types of unethical & ILLEGAL things with your IDENTITY!!! If I were you, I'd contact a Lawyer, your Local T.V. Station's Investigative Reporters (all of them), and even www.stopautofraud.com

They SHOULDN'T be able to SELL YOUR CAR (the Prius) until the deal is completely done, & approved!!!! They WILL LIE to you!!!! Almost ALL Toyota Dealerships, as well as Toyota Corporation, are CONSPIRING to FINANCIALLY INJURE INNOCENT CONSUMERS all over the USA!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

NATIONWIDE ALERT: All Toyota Dealerships have THOUSANDS of people's IDENTITIES that are stored at the Dealership in files that are usually upstairs in their offices. ANYONE at the Dealership, including Salespeople, Sales Managers, General Sales Managers, etc., COULD go into those files and take YOUR PERSONAL INFORMATION!!!!!!!!!!!!!!!!!!!!!!!!!!!!
Why would they do this? ANSWER: Because times are TOUGH for these people right now!!! Sales & profits are WAY DOWN. So, they COULD steal your IDENTITY and SELL IT to others and make MONEY!!! MONEY that they desparately need right now!!!!!!!!!!!!!!!!!

If I were ANYONE who purchased or leased a vehicle at a Toyota Dealership in the last 6 years I'd go into that Dealership RIGHT NOW and DEMAND to see WHERE MY PERSONAL INFORMATION was being stored. I'd want to see if it was SAFE & SECURE!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
