Over the past few weeks I have been getting these phone calls from a company called NCO Financial, they call 3-5 times per day on my cell phone and home phone (they have yet to call me at work - and given what I have been reading about them... I would not put it past them)

Yesterday I get a voice mail from this person saying to call this number... stating that a case in maricopa county has been filed against me but gave no further details. He acted like he was an attorney.

So I called from a pay phone, and guess what...it was NCO again.

I do not know who this company is or what they want from me. They say that I owe them like $7,000... I then pulled my credit (which I normally do every 2-3 weeks) and check as far back as I could go, there is NO ACCOUNTS for either NCO or NEXTCARD on my credit report.

However I checked under inquiries and on October 8, they listed an inquiry from NCO as a collection agency.

How can they do this?

I can only venture to guess that when one of my cars were broken into a few years back that some information was taken from me and an account was opened in my name, but it never made it on my credit report so I never worried about it.

Any suggestions?

I use to get calls from NCO 3 to 4 times a day. This one woman that called all the time use to yell scream and shout at me.. call me names, ect ect ect.

One day during one of her lovely calls, she was telling me that I was a deadbeat and a lozer and that I should just pay ( without proof of debt ).
I asked her if her office over looked the street in front of the building. She asked why?
I told her that in about 1 min she would see my van drive by and I would be more then willing to make a stop to discuss this matter with her in more detail, along with her supervisor and his supervisor.
She hasnt called back since.

Its funny, when they call you on a cell phone, they never know where you might be and I guess she didnt expect me to be there LOL

Always send a letter of validation to NCO and when they dont validate and they continue to harrass you.. sue them.

This letter serves as purpose that this is not valid debt owned by me, I do not recognize this debt, the amount, account numbers, creditors, etc.

This letter serves as notice that you are to stop harassing me regarding this debt, and that you provide a validation letter and a copy of a contract that shows my signature that this debt is valid and that I approved it, unless you can provide such documentation you are ordered to hereby stand down, and contact me no further.

This account does not appear on my credit reports. I did however see an illegal inquiry made on my report from NCO on Oct 8, 2004. You are ordered to remove that inquiry as I did not authorize it.

Your attempts to try and collect on account that does not belong to me are illegal and any communication from you whether in mail or phone will be used against you in a court of law per the Fair Credit laws.

Any attempts to add this unknown debt to my credit report will be met with the strongest legal action available to me, and a lawsuit filed against you for the amount you are seeking from me on debt that I do not own.

I will expect a reply in 10 business days with the above requested information, no later than October 26, 2004, at which time I will consider this matter closed.

I have experienced similar with NCO...I recently sent a letter to them certified and registered delivery asking them why did they request my credit report. At no time did I authorize them to request a copy of my credit report---shortly after I got "the phone call and many more calls." They are stating that I owe an account (that I have never heard of) and that does not show up on my credit report. I was advised by Trans Union to send a letter to NCO and to send a copy of NCO's response to Trans Union. Also, I notified all three credit agencies of what NCO is trying to do. I would advise you to do the same. They must prove the debt...in my case it started out $4,000 and in the space of two months has become $5,000. Do not give---I know I will not because I do not owe the debt.

NCO is notorious for making false collections claims. Here is what to do...
Contact the credit bureaus in writting. Dispute NCO pulling your credit by stating that they never had authorization. Also dispute the Nextcard account, if you never had one. This will help prevent that account from touching your credit and at least buy you some time to figure it out.
Next, call NCO. Tell them that this is not your account and will not speak with them until they can prove otherwise, in writting. Make it known and spefifically state that they are harrasing you and they do not have permission to call you. Also, tell them that you are recording the conversation and recording every call that comes in to your telephone. Chances are, they will get a little more friendly seeing how there are telephone harrasment laws. By law, the collection account must provide proof that this is a valid account.
If they tell you that they sent you a notice, they always say that wether its true or not, and tell you that by law they don't have to send it again, that is absolutely false! In order to collect a debt and in order to prove that you recieved notice, they must be able to prove that you recieved notice. Stick to it and don't budge.
If you really want to get them, call THEM every day asking for proof.Let them know what it is like to be harrased.
