I purchased my home in April of 2009 and was told that my house would be done in September but they did not begin building until July and we did not close until November.  In July I stated that our driveway would be too close to our neighbors and that we would not be able to use the garage without backing into the neighbors yard.  They said they would be ten feet apart but is only two feet apart.

When we threaten not to sign the papers on the 6th of November they threaten to sue us for breech of contract even though they breech our contract for the house with the big driveway and we got the right house with the small driveway.  They try to say that we settle by getting a circle driveway that can only fit one car and mismatch molding that looks like crap.

All we wanted was to either make our house a front entrance garage or turn it in to a room so that we could use the space without backing into our neighbors driveway but they have refused.  In their Homeowner manuel it states that a homeowner should have reasonable access to there driveway and garage and We do not have a reasonable access to our garage.

I am disable retiree of the Marine corp.  I am 100% disable from the VA and also receive social security and cannot work.  I have three children and beautiful wife and this was supossed to be our dream home that we would grow old in and it has turn into a nightmare.

DO NOT BUY D.R. HORTON HOMES THEY CANNOT BE TRUSTED!!!!!!

Are you saying that you are asking DR Horton to turn your garage into a room because your driveway is two feet away from your neighbor's driveway?

Usually there are building codes in every city. Go to your local building department and find out what the minimum required distance is between your driveway and your lot line. The building department will let you know and if DR Horton is in violation, you can have them fix your driveway to be in conformity with the code.

IMO asking the builder to convert your garage to a room is completely out of line. I'm not sure what you were saying in your post, but it sounds like you were asking them to change the garage from a side load garage to a front load garage after it is built. That is a very expensive proposition. Neither of these solutions you proposed would fix the problem. I am assuming you want to fix the issue of your driveway being too close to your neighbor's driveway. Work with the city and the builder to get a solution to your issue rather than asking for the sky and the moon. JMO.
