The short version:

My brother and I loaned Derik Hixon, owner of DK Coaches $75,000.00, with a promise of a return of the money in 6 months with interest. Derik signed over the ownership of his production motorhomes as collateral. There is a signed contract agreeing to a return on the loan with interest within 6 months time including a percentage of the money earned renting the motorhomes, which is the business of DK Coaches. For the first six months I had to call Derik to get an update, he never called us and he rarely returned calls. About 10 months later Derik informs us that the motorhomes were taken by the bank but promises he can still get us our money. From then on it’s been, lies, stories changing, and other deceitful excuses to put us off of taking legal action. In the 10 years since the contract was signed, he’s paid back just over $11000.00 total.  Derik has since filed for bankruptcy and never named us as debtors, although he says he did. For the past 5 years Derik Hixon has refused to answer or return my calls and emails. I have to call him from a number he doesn’t recognize in order to get him to answer. When we do get him on the phone, he still says he has every intention of paying back the loan and that he’s working on a plan to make money with investors. Recently, Derik Hixon has posted to Facebook bragging about his financial status including “peeling off” $100 bills for sports bets, purchasing large screen 4K TVs and taking trips to France. A file of contracts, email exchanges and social media posts from Derik Hixon have been kept to back up all these claims.
