In 2002 I was defrauded by a seller on Ebay who used a ficticious name and phone number. I purchased 3 Hummels that were supposed to be "full Bee" TMK. Instead, I received 3 Hummels that had less valuable TMK's. In short, "Bait and switch."

I reported the billing error to Capital One in May 2002. Capital One credited my account at least twice and debited it at least three times,finally, 115 days later, decided I owed the amount of $231.41.

I refused to pay and protested the handling of the investigation. Later I learned that Capital One never contacted the Vendor not obtained any "evidence" of my indebtedness. In short, they allowed the vendor to rip me off without ever revealing exactly the merchants identification or getting a charge-back.

The account totaled $547.30 when I complained to the Federal Reserve bank. Capital One then wrote the account off as uncollectable.

I have sued them in Federal Court and will let you know the outcome.
