I deposited my payroll check into my account using mobile app upload. About an hour later my debit card begins to decline. I called into customer support and was told the check I deposited was identified as a scam and that I should go file a police report. I knew for a fact the company was legit but there was no reasoning with the CS rep. I was told my account would be frozen. The e-mail I received said my funds would be transferred to my attached external account in ten days. Almost two months laer and customer service no longer takes my calls and just forwards me to a voicemail. I was told no one would be calling me back because the account was closed. If my account is closed then why wasn't I sent my money from the account. And if CapitalOne 360 is going to refuse my phone calls to inquire about my funds that are in the account, again why not send my money. This is damaging to people with bills and then the bank won't even take your call. I can't even get an answer on when I can expect to receive my money. My job has even tried reaching out to them to provide any information that proves they are not a scam. Today makes nearly three months I have been employed with this company. The problem was the company I am contracted with is based in Chicage, Illinois and Columbus, OH. This must have sent a red flag to CapitalOne 360 but they were to lazy to verifiy the information. They will never get my business again ever!!

Complaint with CFPB

I have already filed a complaint with the Consumer Financial Protection Bureau. CFPB has forwarded my complaint to CapitalOne 360 who after 3 wks of receiving the complaint responded they need more time. That is unacceptable when my account was closed on 6/29/18 and this is August. And based on that response they could take another 60 days to finish doing whatever before they have to respond to my complaint. My subsequent checks have cleared WF with no issues.

I got to assume 2 months down the road, your subsequent paychecks all cleared at other banks. If so, then you need to contact whatever state agency oversees banks in your state. Even though Cap One operates mostly online, if they've taken your business, they're beholden to your state laws.

If the amount they're holding is low enough, you might even try small claims, but I'd try to sick the state regulator first.

What exactly has become of your subsequent checks?

A lot of people do take jobs with scammers only to find that out when it comes time to get paid.

You can't expect a bank to take your word for it that a company is legit.
